Terms and Conditions of Service
If you use PayPal… we feel this is the most secure way to make debit or credit card payments on the internet. Their security is unsurpassed, their system has been refined through years of transactions, and it does not require an account for usage… One of the biggest plus points for using PayPal is the fact that we do not see your credit card account information; we do not store you credit card account information in any way; we do not refer your account information to any outside services for account verifications…Your account information is not transferred through insecure pathways over the internet.
Our 3, 6 and 12 month contracts are non-refundable (pending the usual 72 hour state contract laws), and we suggest you start first with our month to month contract if you are not sure your site will be up that long.
For Customers that exceed their monthly Traffic Allowance, exceed their Disk Allowance, or use other enhanced services of Studio Seven Pro Hosting, we will require the Customer send in an additional amount as indicated in the domain features and pricing guide as a deposit for the additional resources. Customers should deposit at least one month worth of expected additional fees in advance. Any leftover amounts will be credited to your account. If you anticipate additional costs, please contact us to make arrangements. We feel that most clients, on the average, will never have overuse conditions, so the possibility of this becoming an issue is very, very slim.
• Studio Seven Pro Hosting reserves the right to change accounts within three (3) days notice, and the right to refuse service to anyone for reasons defined by federal guidelines, or our business guidelines as stated below.
• Studio Seven Pro Hosting is a private service, thus we may exclude or deny our services to whomever, at our discretion.
Our policy regarding pornographic materials:
• Studio Seven Pro Hosting does not allow the posting of pornographic materials on any site administrated on our servers.
• Studio Seven Pro Hosting does not allow the transfer of pornographic materials via our services provided, such as email, ftp file transfers, or any other means of transfers.
• Studio Seven Pro Hosting has final word on these matters as to what constitutes pornographic materials, when using Studio Seven Pro Hosting services.
• Studio Seven Pro Hosting is a private service, thus we may exclude or deny our services to whomever, at our discretion.
• Any instance of these aforementioned activities regarding pornographic materials is ground for immediate cancellation of access to any materials stored on our servers, and if so deemed, the authorization of law enforcement authorities to confiscate, or view such related materials.
Our policy regarding “spamming”, the use of email transfer for illegal or unsolicited communications, hijacking of email addresses, or any activity defined by the US Government as illegal use of email or ftp transfers:
• Studio Seven Pro Hosting does not allow the activities associated with spamming or hijacking of email accounts for unsolicited, or illegal activities.
• Any instance of these aforementioned spamming activities will be grounds for immediate cancellation of access to any materials stored on our servers, or services provided by Studio Seven pro hosting…and if so deemed, the authorization of law enforcement authorities to confiscate, or view such related materials

Studio Seven Pro Hosting will provide the hardware and system administration necessary to provide World Wide Web access to the Internet community. At Customer's request, Studio Seven Pro Hosting will assign a unique domain name to our servers (i.e., www.yourname.com) provided that the name is legally registered to and under the control of the Customer. Customer understands that domain name registration can take some time, and is not under Studio Seven Pro Hosting's control. Under normal circumstances we can have the domain name up in 2-3 business days. Studio Seven Pro Hosting will, however, assign a working IP address to the Customer's pages immediately so Customer can begin uploading and testing.
Studio Seven Pro Hosting can register your domains for you - you will be billed by us for your domain registration, $25 per year for .com, .net, .org., for the service of the registration process, while the actual fees for the domain must be paid by you. If you decide to use another registration service for your domain name, then you will be billed by that company separately. It is the customer's responsibility to maintain their domain record and to make sure the domain registration fees are paid up to avoid service disruptions. Studio Seven Pro hosting assumes absolutely no responsibility for domain name registration fees, nor for the payment of domain name fees for any client, even if the domain name was registered by Studio Seven Pro Hosting as a service to a client. So, Studio Seven may handle the process of registration, but is not responsible for the fees required for registration, nor responsible if the domain name registration is lost because of non-payment, or any other reason.
Customer understands and agrees that Studio Seven Pro Hosting will make every effort to keep our network of servers running continuously. However, our servers will, from time-to-time, be disconnected due to routine maintenance, upgrades and other required events. Studio Seven Pro Hosting will make its best effort to keep all information on our servers backed-up. However, we recommend that the Customer maintains a separate back-up of any information posted to our servers. Studio Seven Pro Hosting is not responsible for lost materials or information.
Studio Seven Pro Hosting will also make its best effort to maintain security on our network of servers. However, the nature of the Web and the Internet is not secure by default. Customer assumes responsibility for the protection of Customer's files and directories. Our Secure Servers use the Secure Sockets Layer ("SSL") between a compatible web browser and our servers. Information forwarded from our Secure Servers that does not use SSL will not be as secure as using SSL.
Studio Seven Pro Hosting shall not be liable for any loss of business, lost profits, lost data, failure of security or any or all indirect or consequential damages whether or not such damages are foreseeable. In addition, Customer assumes full responsibility for all content posted to Studio Seven Pro Hosting's servers on Customer's behalf, including any trademark, copyright, patent or other intellectual property submitted to Studio Seven Pro Hosting for either creative services and/or straight posting to our servers. Studio Seven Pro Hosting reserves the right to remove any material which, in its sole opinion, may result in a violation of intellectual property rights of others or any other applicable Federal, State, Common, International laws or regulations. Studio Seven Pro Hosting and Customer may cancel this agreement at any time with written notice.
Studio Seven owns the intellectual rights to all software implementation for any website running on our servers, including the right to adjust any software implementation for sound website functioning. Studio Seven owns all rights to data hosted on their servers, unless written agreements have been made stating otherwise. Studio Seven is acting as host for website data, and does not grant privileges for access at administrative level, as this may constitute a security breach for other clients hosted by Studio Seven. Lower level administrative access will be handled with passwords and limits to administrative functions.
Cancellation of any account for whatever reasons does not obligate Studio Seven for further management of this cancelled account. Website access will be immediately blocked and if necessary all data and files will be deleted. Accounts overdue or unpaid will be handled on an individual basis, with Studio Seven retaining rights to block access to files, data, and/or website internet delivery until non-payment of services is rectified.
In the event that this contract is canceled by Studio Seven Pro Hosting, the Customer will have a pro-rated refund of any unused portion of the billing period. Domain registration fees are non-refundable. Customer acknowledges that these terms and conditions are subject to change without notice. Customer's continued use of Studio Seven Pro Hosting constitutes customer acceptance of these and any and all modified terms.
Studio Seven acts as an independent service provider and our services are not recognized as being “work for hire”, as defined by many state and federal level provisions for business services. All of our services are conducted at our facility, under our software licenses, using our equipment and facilities exclusively. Any implications of contrary status to this standard are considered unfounded and ignorant of federal guidelines protecting our copyrights, and our rights as citizens of the United States to conduct business in a lawful fashion.
